I. General provisions 1. The Communication and Information Agency of Uzbekistan (hereafter as Agency) is a coordinating body of administration, authorized for problem solution and carrying out the state policy in the sphere of communication, information and radio frequency spectrum use. The Agency in its activity is affiliated to the Cabinet of Ministers. The Agency is executing the functions of operating body of Coordinating Council on development of computerization, information-communication technologies. 2. Into the system of Agency are included: · The Fund of information-communication technologies development - financing issues of priority and socially significant projects, scientific-engineering activities in the field of communication and information-communication technologies development; · The Scientific Engineering and Marketing research Center is the organization of marketing researches and monitoring in the field of post communication and telecommunication systems, systems and information resources, certification of technical means; · The State Inspection of Communication – carries out the state control of economic entities activity, providing the services in sphere of post and telecommunications in the Republic of Uzbekistan; · The State Commission on Radio Frequency of the Republic of Uzbekistan (interdepartmental collegial body) – coordination of works in the sphere of regulation of radio frequency spectrum use in the Republic of Uzbekistan; · Tashkent University of Information Technologies – carries out the training, retraining and qualification courses of specialists in the field of communication, information-communication technologies, development of software, e-commerce, information security, economy and management, as well as carrying out the scientific-engineering works in sphere of communication and information; · The State Dispatch Service – realizes the reception, delivery of correspondence of the Supreme Governmental Bodies of Administration, and as well as the diplomatic correspondence; · Republic Special Communication Center – realizes the reception, delivery of special correspondence and sendings of agencies, organizations and companies of the Republic; · Republic Centre of Telecommunication Networks Management of Uzbekistan – coordination and maintenance of effective functioning of telecommunication networks, rational use and development of telecommunication resources, creation of coordinated network management systems of various operators for most satisfaction of needs in telecommunication services, maintenance of priority use of networks in the interest of governmental bodies of administration, defense and national security of the Republic of Uzbekistan; · The Centre of Radio Communication, Broadcasting and Television – distribution and transmission of TV-broadcastings all over the territory of the Republic of Uzbekistan, provision of radio communication services through radio channels; · The Centre of Electromagnetic Compatibility Center – carrying out the functions of radio frequency body on authorization of the use of radio frequencies, maintenance of electromagnetic compatibility and monitoring of radio frequency spectrum; · Computer and information technologies implementation and development Center – elaboration of software projects and normative-legal acts in the sphere of information-communication technologies development, provision of wide spectrum of information, consulting services; · The Special Emergency and Restoration Control (military administration) – carrying out the emergency-restoration works on communication objects and telecommunication networks of the Republic of Uzbekistan in peacetime and in special period, maintenance with military guard of most important and categorized objects of communication; · Data Transmission Network Company «UzPAK» – provision of services on data transmission for satisfaction of information needs of state and public bodies, citizens, companies, agencies and organizations, implementation of technical means, perfection of communication basis of unique information space of the Republic and widening the opportunities of its entrance into the world information space; · The Scientific-manufacturing Company «Granite» – designing reconstruction, installation, adjustment, launching into the operation of control systems by radio technique, radio communications, telecommunications, information-communication technology means and computer facilities, including the manufacturing of means and not typical products for subjects of special assignment. 3. The Agency in its activity is guided by the Constitution and Legislations of the Republic of Uzbekistan, Resolutions and other legislative documents of Supreme council of the Republic of Uzbekistan, Decrees, Resolutions and Regulations of the President of the Republic of Uzbekistan, Resolutions and Regulations of the Cabinet of Ministers of the Republic of Uzbekistan, as well as the present Statute. 4. The Agency carries out its activity in interaction with other state bodies, Governing bodies, public associations and other organizations. 5. The Agency is the body, which authorized to represent the Republic of Uzbekistan in the International Telecommunication Union (ITU), Universal Post Union and in other international organizations in the sphere of information and communication. 6. Material-technical support, and payment of workers salaries of the Central Office of Agency and its regional administrations are carried out due to the finances of the Fund of information-communication technologies development, and also other sources which are not forbidden by the legislation. Material-technical support of subordinate organizations, enterprises and establishments, and also payment of their workers salaries are carried out due to the finances of state budget (educational institutions, special enterprises, military divisions which are under the budgetary financing), due to its own finances, finances of the Fund of information-communication technologies development of development, as well as other sources which are not forbidden by the legislation. 7. The Agency is a legal body, which has a seal with the image of the State Emblem of the Republic of Uzbekistan as well as its name. II. Tasks and Functions of the Agency 8. The Primary goals of the Agency are: · Formation and realization of strategic priorities, realization of effective state regulation in the fields of telecommunications networks development, data transmission, radio communications, broadcastings, TV, post communication, press dissemination, and also in the sphere of information, in the market of information resources and radio-frequency spectrum use; · Coordination of activities of sectorial and territorial bodies and communication and information services, as well as the questions provision of standardization, certification and licensing of economic entities activities, improvement of regulatory-legal base in the sphere of communication and information, including the fields of modern technologies of data transmission and IP-technologies; · Elaboration and realization of complex of actions on creation and development of state bodies information systems, sectorial and territorial information systems; on formation of state information resources; on development and realization of transition programs to electronic forms of information exchange within the state administration, science and education, business, public health services and in other fields of activity; · Information security provision in networks of telecommunication and post communication, TV-broadcasting, information systems, implementation of effective means and methods of information resources and information systems protection in view of modern requirements, as well as their priority use in interests of state administration, defense and national security of the Republic of Uzbekistan and in conditions of extreme situations; · Organization of control and execution of license agreements by economic entities, the effective utilization of radio-frequency spectrum and activities on information security provision in networks of telecommunications, post communication, TV-broadcasting, information systems; · Organization of research works and training of high-skilled staff in the sphere of information-communication technologies and systems, development of computer and telecommunication technologies, on preferred directions of development of sphere of communication and information; · Approval in accordance with established procedure of standards, specifications and requirements to radio-electronic means, telecommunication mean and information-communication technologies, organization of elaboration and approval of state standards, as well as the introduction of international standards; · Attraction and effective use of investments and modern technologies for development and improvement of networks of telecommunications, data transmission, TV-broadcasting, post communication and information systems; · Realization in collaboration with antimonopoly body the activities on protection of consumer rights in the sphere of communication and information; · Organization of interactions and coordination of territorial authorities with local bodies of state administration and control at realization of strategic priorities, at realization of effective state regulation in the field of telecommunication networks development, data transmission, TV-broadcasting, post communication, press dissemination, in the market of information resources and systems. 9. For execution of these tasks the Agency carries out the following functions: · Develops and organizes the realization of National Programs and Concepts of communication and information development, promotes the development and realization of regional programs; · Develops and brings due to the established procedure to the Cabinet of Ministers of the Republic of Uzbekistan the drafts of legislative and regulatory acts concerning the questions of activity of the sphere of communication and information, radio-frequency spectrum use; · Develops and provides for approval in established order the state standards, organizes the introduction of international standards, develops and approves the branch standards, technical specifications and requirements for radio-electronic means, means of telecommunication and information-communication technologies with a view of creation of the unique information space of the country; · Approves the samples and establishes the order of edition of state signs on postal payment, realizes the introduction and their drawing from circulation; approves the postal indexes, specifications of postal correspondence collection frequency, as well as the control terms of postal items passing, which are obligatory for operators and providers; · Approves the order and conditions of telecommunication networks connection, data transmission, post communication and provision of mutual services and realization of mutual payments by operators and providers; · Organizes the works on scientific and marketing researches, on development monitoring and improvement of information technologies, networks and services of communication, branch standards and technical specifications, studying and analysis of domestic and world tendencies of telecommunication networks development, data transmission, TV-broadcasting, post communication, information-communication technologies and preparation of the reports on them; · Organizes and coordinates the activities on formation of information resources of state bodies, of legal and physical persons, created due to the state budget finances, as well as the resources containing the state secrets and confidential information; · Organizes the activities on monitoring of radio-frequency spectrum use, radio-electronic means and high-frequency devices, and also exception of radio noise, including the industrial; · Develops and approves in established order the rules and the order of organization, as well as the realization of state control over the activity of economic entities on creation and functioning of communication networks, systems and means of information; · Realizes in established order the licensing of separate kinds of activity in the sphere of telecommunication; · Approves the plan and phone numbering system, allocation of numbering, carries out the accounting and control of use of telecommunication networks numbering resources, distribution of address space of national segment of Internet system; · Determines the requirements and elaborates the normative documents concerning the protection of networks and means of post communication, telecommunication, data transmission, TV-broadcasting, information systems and resources; · In collaboration with interested Ministries and Departments develops and organizes the fulfillment of complex of actions with a view of provision of defensibility and national security, uninterrupted and safe functioning of especially important and categorized objects in the sphere of communication and information, the liquidation of consequences of natural disasters with the use of technical forces and economy entities means, irrespective of Departmental accessory; · In established by the legislation order establishes the list and requirements to the quality of universal services of post communication and telecommunications, approves the tariffs for universal services of post communication and telecommunications; · Establishes the list of separate services of telecommunication and coordinates the tariffs for them and gateway connections in view of interests of users; · Organizes the development of software products and implements them in the branches of economy for use in industrial and administrative processes; · Promotes the creation of information systems of the state bodies, branch and territorial information systems, formation and development of the software products market, information resources, services in the sphere of communication and information; · In collaboration with the state antimonopoly body promotes the creation of equal conditions for economy entities activities, for development of competition and protection of consumers rights in sphere of communication and information; · In collaboration with the Ministries and Departments, included to the composition of State Commission on radio frequencies, provides realization of a state policy in the field of distribution, radio-frequency spectrum use and realizing the control of observance of the legislation in the given sphere; · Coordinates the activities of state bodies and economic entities concerning the questions on communication and information; · Represents itself as the authorized body of the Republic of Uzbekistan which carries out the international activity in the sphere of communication and information, radio-frequency spectrum use, on behalf of the Republic of Uzbekistan participates in Congresses, Conferences of the International Telecommunication Union, Universal Postal Union and other international organizations in the sphere of communication and information, radio-frequency spectrum use; · Participates in preparation of projects of interstate and intergovernmental agreements and contracts in the sphere of communication and information, radio-frequency spectrum use; · Concludes in established order the international interdepartmental agreements and contracts in the sphere of communication and information, radio-frequency spectrum use; participates in development and realization of investment policy and attraction of foreign investments on development of means and networks of post communication, telecommunication, TV-broadcasting, information systems and technologies, technical specifications, radio-monitoring, software products, organizes the support of socially significant services, scientific researches, training and retraining of experts; · Determines the priority directions of use of international financial institutions grants, grants of foreign countries grants, allocated for the sphere of communication and information and radio-frequency spectrum use; · Organizes and participates in provision of tenders, contests and in trades on attraction of investments, including the foreign, on development of the sphere of communication and information and radio-frequency spectrum use; · Carries out the direct conduct of work of the territorial authorities, subordinated state organizations, enterprises and establishments, determines the basic directions of their activity; · Carries out the control over fulfillment by economic entities of license agreements, radio-frequency spectrum use, technical and technology requirements on security in networks of post communication and telecommunication, data transmission, TV-broadcasting, in information systems of state bodies and economy entities; · Cooperates with law enforcement bodies concerning the provision of monitoring, revealing and suppression of offences in the sphere of communication and information, radio-frequency spectrum use, as well as on places; · Develops and brings in established order the proposes on improvement of structure in the sphere of communication and information according to the legislation of the Republic of Uzbekistan; · Develops the mobilization plan, structure, composition, norms and accumulation plan in the material means state reserve of Agency system, with the help forces and means of military unit organizes the provision of emergency - regenerative activities for maintenance with communication of bodies of government administration, and protection of especially important objects of the Agency system; · Organizes the interactions and coordination of territorial authorities with local bodies of the government administration and control at realization of strategic priorities, as well as at realization of effective state regulation in the field of telecommunication networks, data transmission, TV-broadcasting, post communication, press dissemination, markets of information resources and systems, radio-frequency spectrum use development; · Organizes the budgetary financing of the educational institutions, special enterprises, military divisions which are included into the Agency system, and are under the budgetary financing; · Establishes the scholarships of Agency to high-skilled students of educational institutions in the sphere of communication and information. 12. The Agency solves the tasks and functions assigned to him, as well as through the territorial authorities, subordinated organizations, enterprises and establishments. IV. Rights and Responsibility of the Agency 13. The Agency for fulfillment of tasks and functions assigned to him has the right concerning the following: · To request the necessary information from the state bodies, ministries and departments, economic entities on questions concerning the competence of Agency; · To give the licenses for the operation of radio-electronic means and high-frequency devices in the Republic of Uzbekistan, as well as to stop, suspend and limit the radio-frequency spectrum use; · To make the proposals in accordance with established order to the Cabinet of Ministers of the Republic of Uzbekistan and to the state bodies of administration on questions which are included into the competence of the Agency; · At force-majeure circumstances (military actions, earthquakes, flooding, fires, epidemics and others) of priority use, as well as restriction or suspend of functioning of any networks and means of post communication, telecommunications and information systems; · To forbid in accordance with established order the operation of radio-electronic means and high-frequency devices in case of their discrepancy to the established standards and technical norms, non ensuring the citizens safety, preservation of environment, non application of payment for radio-frequency spectrum use, as well as under special circumstances; · To conclude in accordance with established order the international interdepartmental contracts in the sphere of communication and information; · To accumulate the means of organizations and companies of the sphere of communication and information, which are on voluntary basis given for payment of membership contributions of the Republic of Uzbekistan in the international organizations of the sphere of communication and information. The Agency has the exclusive right of input into the circulation and withdrawal from the circulation of the state signs on post payment. The Agency can have the other rights according to the legislation of the Republic of Uzbekistan. 14. The Agency within the limits of its competence has the right to accept the regulatory-legal acts, which are obligatory for fulfillment by the ministries, state committees, departments, governmental administration bodies, enterprises, establishments, organizations, official persons and citizens. The Agency has the right, in certain cases, to issue jointly with the other ministries, state committees and departments the joint resolutions and other acts. 15. The Agency bears the responsibility for provision of the realization of the state policy in the communication and information sphere, as well as the effective fulfillment of the tasks assigned to it. V. Organization of Agency activity 16. The Agency is headed by the Director General, appointed and dismissed from his position in accordance with established by the legislation procedure. Director General has the Deputy Directors, as well as the First Deputy, the quantity and appointment of whom is realized by the Cabinet of Ministers of the Republic of Uzbekistan. According to the status the Director General is equated to the Minister, the first Deputy Director and other Deputies of the Director General - to the first Vice Minister and other Vice Ministers accordingly. 17. The Director General of the Agency simultaneously is the chairman of the State Commission on Radio Frequency of the Republic of Uzbekistan. 18. The Director General of the Agency: · Carries out on the basis of individual authority the general conduct of the Agency; · Makes the decision on questions which are included into the competence of the Agency, and bears the personal responsibility for fulfillment of tasks and functions assigned to Agency; · Determines the powers of his Deputies, allocates the responsibilities of each of them, establishes the powers of official persons of the regional authorities, state organizations, enterprises and establishments of the Agency system; determines the responsibilities degree of the his Deputies and other officials for the chairing by the separate fields of the Agency activity and activities of the territorial administrations, subordinated organizations, enterprises and establishments; · Issues the Decrees and Instructions, which are obligatory for fulfillment by the workers of the Agency system; · Makes the changes into the structure, approves the staff list of the Central office, regional authorities of the Agency within the limits of established numeration, as well as the ñìåòó ðàñõîäîâof the Central office of the Agency, regional authorities, state subordinated organizations, enterprises and establishments financed due to the budget; · Approves in established order The Provisions of Departments, Territorial administrations of the Agency, Provisions (Statute) of the state subordinated organizations, enterprises and establishments which are included into the Agency system; · Under established order appoints to the position and dismisses the workers of the Central office of the Agency, the Heads of the territorial administrations, subordinated state organizations, enterprises and establishments which are included into the Agency system. The Director General carries out the other obligations according to the legislation. 19. In the Agency is formed the Board with following eleven (11) members: Director General (Chairman), Deputy Director General (according to provision) and other executives of the Agency system. The personal staff of the Board is approved by the Cabinet of Ministers of the Republic of Uzbekistan on presentation of the Director General. The Board of the Agency considers the basic problems of the Agency activity, listens to the reports of heads of the Agency departments, territorial administrations, subordinated organizations, enterprises and establishments, discusses the drafts of the important decrees and other acts of the Agency, as well as the problems of development of the communication and information sphere, the wide-scale use of scientific and technical achievements, interdepartmental and interstate communications development. The Decisions of the Board are put into practice under the orders of the Director General. In case of disagreements between the Director General and the Board, the Director General realizes his decision. The Director General informs the Cabinet of Ministers of the Republic of Uzbekistan on the arisen disagreements. 20. The Territorial Administrations carry out their activities according to the positions confirmed by the Agency. The Territorial Administrations are headed by the Heads appointed and dismissed from the position by the Director General of the Agency. The names of the Territorial Administrations: Territorial Administration of the Communication and Information Agency of the Republic of Karakalpakstan; Territorial Administration of the Communication and Information Agency of Andijan Region; Territorial Administration of the Communication and Information Agency of Bukhara Region; Territorial Administration of the Communication and Information Agency of Djhizakh Region; Territorial Administration of the Communication and Information Agency of Kashkadarya Region; Territorial Administration of the Communication and Information Agency of Navoi Region; Territorial Administration of the Communication and Information Agency of Namangan Region; Territorial Administration of the Communication and Information Agency of Samarkhand Region; Territorial Administration of the Communication and Information Agency of Surkhan-Darya Region; Territorial Administration of the Communication and Information Agency of Syr-Darya Region; Territorial Administration of the Communication and Information Agency of Tashkent Region; Territorial Administration of the Communication and Information Agency of Fergana Region; Territorial Administration of the Communication and Information Agency of Khorazm Region.
